Acceptance of Terms

By downloading, installing, or using Orbiq software ("the Software"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Software.

License Grant

Orbiq Lite (Free Version):

• Personal and commercial use permitted
• Installation on unlimited devices
• Basic desktop management features included
• No warranty or support guarantees

Orbiq Pro (Paid Version):

• Single-user license for $20.00 USD
• Installation permitted on devices owned/controlled by the licensed user
• Advanced features and professional tools included
• Priority support and updates included
• Commercial use permitted under single-user license terms

Permitted Uses

You may use Orbiq to:

• Organize and manage desktop shortcuts and applications
• Enhance productivity through desktop automation
• Customize your Windows desktop environment
• Use in personal, educational, or commercial environments (within license terms)

Prohibited Uses

You may NOT:

• Reverse engineer, decompile, or disassemble the Software
• Remove or modify copyright notices or licensing information
• Distribute, resell, or sublicense the Software without authorization
• Use the Software for illegal or harmful activities
• Share Orbiq Pro licenses with multiple users (single-user license only)
• Use the Software to violate third-party rights or applicable laws

Intellectual Property

Orbiq software, including all code, designs, trademarks, and documentation, is the intellectual property of the developer. This license grants you usage rights but does not transfer ownership.

Trademarks and Brand Elements

The following are trademarks and proprietary brand elements of Orbiq:

• Orbiq Kraken Icon: The distinctive tentacled sea creature logo used throughout Orbiq Pro is a registered trademark. Unauthorized use, reproduction, or modification is strictly prohibited.
• Orbiq Sphere Icon: The spherical geometric logo used in Orbiq Lite and associated branding materials is a registered trademark. Any unauthorized use constitutes trademark infringement.
• Orbiq Name and Branding: The "Orbiq" name, associated taglines, and brand elements are protected intellectual property.
• JodyLabs Attribution: Development attribution to JodyLabs must remain intact in all distributions and derivative works.

Trademark Protection: These trademarks are protected under U.S. and international trademark law. Any unauthorized use, reproduction, distribution, or modification of these trademark elements may result in legal action for trademark infringement, unfair competition, and damages.

Permitted Use: You may reference these trademarks only in the context of describing or discussing Orbiq software. Commercial use of these trademarks outside of licensed software use is strictly prohibited without written permission.

Privacy and Data

Orbiq is designed to respect your privacy:

• All personal shortcuts and settings are stored locally on your device
• No personal data is transmitted to external servers
• Optional anonymous usage analytics may be collected to improve the software

Disclaimers and Limitations

The developer shall not be liable for:

• Any direct, indirect, incidental, or consequential damages
• Loss of data, profits, or business interruption
• Damages resulting from software use or inability to use
• Third-party software interactions or compatibility issues

Payment and Refunds

Orbiq Pro purchases:

• Payments processed securely through PayPal
• License activation typically occurs within 24 hours of payment
• Refunds considered on a case-by-case basis within 30 days of purchase
• Contact support for refund requests with purchase details

Updates and Support

Software Updates:

• Updates may be provided at the developer's discretion
• No guarantee of continued updates or new features
• Major version updates may require separate licensing

Support:

• Orbiq Lite: Community support and documentation
• Orbiq Pro: Priority email support for licensed users
• No guarantee of response time or issue resolution

Termination

This license remains effective until terminated. Your rights terminate automatically if you violate these terms. Upon termination, you must discontinue use and delete all copies of the Software.

Governing Law

These terms are governed by the laws of Kentucky, United States. Any disputes shall be resolved in the courts of Pike County, Kentucky.

Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the Software after changes constitutes acceptance of new terms. Significant changes will be communicated through our website or within the application.

Severability

If any provision of these terms is found unenforceable, the remaining provisions shall remain in full force and effect.
